Companies seeking a judicial review of Ofgem’s decision to cut Triad benefits have sought an injunction that would prevent the decision taking effect on April 2018, as planned. A hearing is due to take place on 23 January. Ofgem said the decision will take effect on 1 April, unless the injunction is granted.
The claimants asked for the court to deal with the injunction request urgently, because the T-1 Capacity Market auction is due to begin on 30 January. Companies have already had to confirm they are entering the T-1 auction: the window for confirmation closed on Tuesday 16 January.
